The standard rules and guidelines are intended to protect your rights, the rights of other parties involved in the administration and upkeep of these forums, as well as third parties, while ensuring compliance with relevant laws and regulations. By using the Services, you're agreeing to be bound by the Terms and Conditions listed below. You understand that all information appearing on the BRINT Portals is the sole responsibility of the persons posting that information. It is BRINT Institute's policy to take reasonable measures to respect the privacy of BRINT's users. BRINT will take reasonable measures to not disclose the contents of your communications unless required to do so by law or in the good faith belief that such action is reasonably necessary to: (i) comply with legal process; (ii) enforce these terms and conditions; (iii) respond to claims that any Content on BRINT Portals violate the rights of third-parties; or (iv) protect the rights, property, or personal safety of BRINT Institute, its users and the public.
Commercial uses of the Services offered on BRINT Institute are strictly prohibited unless prior written consent from BRINT Institute has been granted. Any use by you of any other member's information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g. mass marketing) is prohibited. Any such use shall be deemed to be a violation of these Terms and Conditions. BRINT Portals and Services are to be used by you for your personal use only. You agree that you will not use them for chain letters, junk mail, 'spamming,' solicitations (commercial or non-commercial) or bulk communications of any kind including but not limited to distribution lists to any person who has not given specific permission to be included in such a list. At the sole judgment of BRINT Institute, if the posting of any message is found to violate the above policy, the responsible party would loose the privilege of being able to access or use any and all of the services offered on the BRINT Portals and Services. In addition, the responsible party must submit to incurring a charge of $10,000 per instance of violation, i.e., for each message posted in violation of the above policy. If the responsible party fails to comply with its contractual obligations, it will also be additionally obligated to pay all costs and fees, including any collection fees and attorneys' fees that are incurred in collecting the owed payments.
Content of External Sites and Resources
BRINT Portals and Services may provide and users may include in posted information, links to other Web sites or resources. BRINT Institute is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. BRINT Institute shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on such external sites or resources.
Copyrights of Posted Material
Services that allow "public areas" may sometime contain material in which users share material they have copied electronically from other sources. Because there are many thousands of possible sources spread out across the Internet, e.g., newspapers, scientific journals and bulletin boards, it is impossible to determine if any information posted on any "public access" Service infringes the copyright of another party. The burden of determining that any information, software, images or any other content on the Services is not protected by Rights rests with you. You acknowledge that BRINT Institute may acquire Rights to use any posted materials as described below, and that you will not acquire any of those Rights by downloading such materials.
By submitting Content to any BRINT Portals and Services, you automatically grant -- or warrant that the owner of such Content has expressly granted -- BRINT Institute the royalty-free, perpetual, irrevocable, non-exclusive and fully sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any Rights that may exist in such content. You also warrant that the holder of any Rights has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the license stated above. You also permit other members of BRINT Institute's user community to access, display, view, store and reproduce such content for personal use. Subject to the foregoing, the owner of such content placed on BRINT Portals or Services retains any and all Rights that may exist in such content.
You may order services or merchandise through BRINT Portals and Services from other parties not affiliated with BRINT Institute ("Seller"). All matters concerning the merchandise and services desired from Seller, including but not limited to purchase terms, payment terms, warranties, guarantees, maintenance and delivery, are solely between you and the Seller. BRINT Institute makes no warranties or representations whatsoever with regard to any goods or services provided by Sellers. Brint Institute EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. Brint Institute MAKES NO WARRANTY THAT ANY CONTENT ON THE Brint Portals AND Services WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES Brint Institute MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF SUCH INFORMATION OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH Brint Portals AND Services. You understand and agree that such Additional Terms are hereby incorporated by reference into these Terms and Conditions.
